What is LMIA?

        The Labour Market Impact Assessment (LMIA) is administered by Employment and Social Canada Development Canada's assessment report to determine whether an employer has the need and ability to hire foreigners. Employers in Canada who want to recruit temporary foreign workers need to submit an LMIA application to the Department of Employment and Development. Once approved, they can use this application to assist the temporary foreign worker to apply for a work visa to work for the employer in Canada.

        The Canadian government stipulates that when the domestic job market cannot meet the needs of businesses, Employers may employ foreign workers. Therefore, when applying for an LMIA, a Canadian employer is required to provide evidence that the employer is trying to consider a qualified Canadian citizen or permanent resident to fill the job before hiring a foreign employee without a suitable candidate.

LMIA Categories

According to the Hourly wage of the employer's province, LMIA is divided into High-wage and Low-wage categories measured by the Median Hourly Wages.

"High salary" category

        Overseas workers can be granted a work visa for up to two years if the vacancy falls into the "high wage" category (the wage is at or above the regional median hourly wage). At the same time, the employer must provide a Transition plan Plan) that while using foreign employees, companies will also take steps to reduce their reliance on temporary foreign labor and ensure that Canadian citizens and permanent residents get jobs first.

        After obtaining positive approval from the LMIA, employers are required to continue to actively train local employees and assist foreign employees who have obtained the LMIA to apply for permanent residence.



"Low pay" category

        If the vacancy falls into the "low wage" category (the wage is lower than the regional median hourly wage), overseas workers will be granted a work visa for up to one year and will need to reapply for the LMIA if they wish to renew it. In this case, the employer is not required to provide a Transition plan Plan), but only 10% of temporary foreign workers in the "low-wage" category are allowed if the enterprise employs more than 10 employees;
