Spouse/common-law Open Work Permit


         Canada has always encouraged and welcomed family reunification, and the Spouse/ legal partner of a foreign student or Work Permit holder who meets certain conditions can apply for a spouse /common-law Open Work Permit to live together in Canada with their spouse.

         The work permit is a type of open work permit that does not require any employer letter (Job Offer) or Labour Market Impact Assessment Permit (LMIA), which allows the holder to do any work for any employer or be self-employed during the validity of the work permit. The duration of the visa will coincide with the spouse's student or work visa and can be requested at the time of the spouse's renewal.

In order to obtain a work visa, you must meet the following requirements 

  •  The spouse/legal partner is an international student
  •  The spouse/legal partner is a foreign worker who meets the following criteria:
    •  Permission to work in Canada for 6 months or more
    •  Meet the minimum requirements for the job (usually at least an associate's degree) with an occupation type of NOC 0, A or B
  •  The applicant is waiting for the domestic spouse reunion immigration: the applicant can apply for this type of open work visa after submitting the immigration application

Definition of Common Law Relationship:

A legal partner in Canada has the same obligations and rights as a spouse; To become a legal partner, it is necessary to prove that both parties have lived together continuously for more than 12 months and that their relationship is no different from marriage. In the first 12 months of cohabitation, there should be no longer separation time, except for a short temporary business trip away from home, or family reunion. Legal partners may be of the same sex or of the opposite sex, but only with one person at a time.
